the National Congress decrees and I sanction the following law: CHAPTER I Introduction Article 1 Telecommunications Services
throughout the country, including territorial waters and airspace as well
as in the places where principles and conventions recognize them extraterritoriality

telecommunications services will constitute continuous trunks and nets that will form
the National Telecommunications System. Paragraph 1. The National Telecommunications System

150 (one hundred and fifty) kilometers established in Law no. 2,597, of September 12, 1955

will have a President of free appointment of the President of the Republic and shall consist of: a) Director of the Post Office
and Telegraphs, acting in that position, which can be represented by chosen person

by the Ministers of War, Navy and Air Force; c) 1 (one) member appointed by the Head of the
General Staff of the Armed Forces; d) 4 (four) members, respectively,
by the Ministers of Justice and Home Affairs, Education and Culture, Foreign Relations
and Industry and Commerce; e) 3 (three) representatives of the 3 (three)
major political parties according to their respective representation in the House of Representatives

admitted by determination of the President of the Republic or the Judiciary. Arts. 21 and 22 (Repealed by Law No. 5,535,
dated 11.20.1968) Art. 23. No member of the Council or servant,
who, in the same exercise, can make part of any company, company, society
or firm which has as its commercial objective telecommunication as director, technician,
consultant, lawyer, expert, shareholder, quotaholder, debenture holder, partner or employee, not so

telecommunications services when the concessions, authorizations or permissions
are not renewed or have been revoked, and there is public interest in the continuation
these services; e) promote, guide and coordinate development
telecommunications, as well as the constitution, organization, articulation and expansion of

art. 9, § 2, of this law. (Parts maintained by the National Congress) g) propose or promote appropriate measures
the execution of this law; h) supervise compliance with the obligations
arising from concessions, authorizations and telecommunications services permissions
and apply the sanctions that are in their authority; i) review concession agreements or acts

telecommunications, and subsidiary companies, associated or dependent on them, or
including those controlled by by foreign shareholders or have as their

for the broadcasting service shall be preceded by notice, published sixty days after the
advance by the competent authority of the Executive, inviting interested parties

no tempo de acôrdo com as respectivas legendas no Congresso Nacional e Assembléias Legislativas. § 1º Para efeito dêste artigo a distribuição
dos horários a serem utilizados pelos diversos partidos será fixada pela Justiça Eleitoral,
ouvidos os representantes das direções partidárias. § 2º Requerida aliança de partidos, a rotatividade
prevista no parágrafo anterior será alternada entre os partidos requerentes de alianças
diversas. § 3º O horário não utilizado por qualquer
partido será redistribuído pelos demais, não sendo permitida cessão ou transferência. § 4º Caberá à Justiça Eleitoral disciplinar

a divulgar, 60 (sessenta) dias antes das eleições mencionadas no artigo anterior, os comunicados
da Justiça Eleitoral até o máximo de tempo de 30 (trinta) minutos. Art. 41. As estações de rádio e de televisão
não poderão cobrar, na publicidade política, preços superiores aos em vigor, nos 6 (seis)
meses anteriores, para a publicidade comum. Art. 42. É o Poder Executivo autorizado a
constituir uma entidade autônoma, sob a forma de emprêsa pública, de cujo capital participem
exclusivamente pessoas jurídicas de direito público interno, bancos e emprêsas governamentais,
com o fim de explorar industrialmente serviços de telecomunicações postos, nos têrmos
da presente lei, sob o regime de exploração direta da União. § 1º A entidade a que se refere êste artigo
ampliará progressivamente seus encargos, de acôrdo com as diretrizes elaboradas pelo
Conselho Nacional de Telecomunicações, mediante: a) transferência, por decreto do Poder Executivo,
de serviços hoje executados pelo Departamento dos Correios e Telégrafos; b) incorporação de serviços hoje explorados
mediante concessão ou autorização, à medida que estas sejam extintas; c) desapropriação de serviços existentes,
na forma da legislação vigente. (Partes mantidas pelo Congresso Nacional) § 2º O Presidente da República nomeará
uma comissão para organizar a nova entidade e a ela incorporar os bens móveis e imóveis
pertencentes à União, atualmente sob a administração do Departamento dos Correios e Telégrafos
aplicados nos serviços transferidos. § 3º A entidade poderá contratar pessoal
de acôrdo com a legislação trabalhista, recrutado dentro ou fora do país, para exercer
as funções de natureza técnico-especializada, relativas às instalação e uso de equipamentos
special § 4º A entidade poderá requisitar do Departamento
dos Correios e Telégrafos o pessoal de que necessite para o seu funcionamento, correndo
o pagamento respectivo à conta de seus recursos próprios. (Partes mantidas pelo Congresso
Nacional) § 5º Os recursos da nova entidade serão
constituídos: a) das tarifas cobradas pela prestação de
seus serviços; b) dos recursos do Fundo Nacional de Telecomunicações
criado no art. 51 desta lei, cuja aplicação obedecerá ao Plano Nacional de Telecomunicações
elaborado pelo Conselho Nacional de Telecomunicações e aprovado por decreto do Presidente da República; c) das dotações consignadas no Orçamento
Geral da União; d) do produto de operações de crédito,
juros de depósitos bancários, rendas de bens patrimoniais, venda de materiais inservíveis
ou de bens patrimoniais. § 6º A arrecadação das taxas de outras
fontes de receita será efetuada diretamente pela entidade ou mediante convênios e acôrdos
com órgãos do Poder Público. Art. 43. As tarifas devidas pela utilização
dos serviços de telecomunicações prestados pela entidade serão fixadas pelo Conselho
Nacional de Telecomunicações de forma a remunerar sempre os custos totais dos serviços,
as amortizações do capital investido e a formação dos fundos necessários à conservação,
reposição, modernização dos equipamentos e ampliações dos serviços. Art. 44. É vedada a concessão ou autorização
do serviço de radiodifusão a sociedades por ações ao portador, ou a emprêsas que
não sejam constituídas exclusivamente dos brasileiros a que se referem as alíneas I
e II do art. 129 da Constituição Federal. Art. 45. A cada modalidade de telecomunicação
corresponderá uma concessão, autorização ou permissão distinta que será considerada
isoladamente para efeito da fiscalização e das contribuições previstas nesta lei. Art. 46. Os Estados e Territórios Federais
poderão obter permissão para o serviço telegráfico interior limitado, sob sua direta
administração e responsabilidade, dentro dos respectivos limites e destinado exclusivamente
a comunicações oficiais. Art. 47. Nenhuma estação de radiodifusão,
de propriedade da União, dos Estados, Territórios ou Municípios ou nas quais possuam essas
pessoas de direito público maioria de cotas ou ações, poderá ser utilizada para fazer
propaganda política ou difundir opiniões favoráveis ou contrárias a qualquer partido
político, seus órgãos, representantes ou candidatos, ressalvado o disposto na legislação
eleitoral. Art. 48. Nenhuma estação de radiodifusão
poderá transmitir ou utilizar, total ou parcialmente, as emissões de estações congêneres, nacionais
ou estrangeiras, sem estar por estas prèviamente autorizada. Durante a irradiação, a estação
dará a conhecer que se trata de retransmissão ou aproveitamento de transmissão alheia,
declarando, além do próprio indicativo e localização, os da estação de origem. Art. 49. A qualquer particular pode ser dada,
pelo Conselho Nacional de Telecomunicações permissão para executar serviço limitado,
para uso privado, entre duas localidades ou em uma mesma cidade, de telex, fac-simile

internacional desde que os serviços para o Brasil sejam executados através da Rêde
Nacional de Telecomunicações e assegurado o recolhimento, pelo permissionário, das
taxas terminais brasileiras e das de execução do trabalho pela União. (Partes mantidas

a execução de serviços de telecomunicações poderão ser revistas sempre que se fizer
necessária a sua adaptação a cláusula de atos internacionais aprovados pelo Congresso

de 20.12.1984) CHAPTER VII Das Infrações e Penalidades Art. 52. A liberdade de radiodifusão não
exclui a punição dos que praticarem abusos no seu exercício. Art. 53. Constitui abuso, no exercício de
liberdade da radiodifusão, o emprêgo dêsse meio de comunicação para a prática de crime
ou contravenção previstos na legislação em vigor no País, inclusive: (Redação dada

judiciary; (Wording given by Decree-Law nº 236, de 1968) b) divulgar segredos de Estado ou assuntos

pelo Decreto-Lei nº 236, de 1968) d) fazer propaganda de guerra ou de processos

from 1968) e) promover campanha discriminatória de classe,
côr, raça ou religião; (Wording given pelo Decreto-Lei nº 236, de 1968) f) insuflar a rebeldia ou a indisciplina nas
fôrças armadas ou nas organizações de segurança pública; (Wording given by

do País; (Wording given by Decree-Law nº 236, de 1968) h) ofender a moral familiar, pública, ou

Legislativos, Executivo ou Judiciário ou os respectivos membros; (Wording given by

falsas houver resultado de êrro de informação e fôr objeto de desmentido imediato, a nenhuma
penalidade ficará sujeita a concessionária ou permissionária. (Partes mantidas pelo
Congresso Nacional) Art. 54. São livres as críticas e os conceitos
desfavoráreis, ainda que veementes, bem como a narrativa de fatos verdadeiros, guardadas
as restrições estabelecidas em lei, inclusive de atos de qualquer dos podêres do Estado.

nos têrmos desta lei. (Partes mantidas pelo Congresso Nacional) Art. 56. Pratica crime de violação de telecomunicação
quem, transgredindo lei ou regulamento, exiba autógrafo ou qualquer documento do arquivo,
divulgue ou comunique, informe ou capte, transmita a outrem ou utilize o conteúdo, resumo, significado,
interpretação, indicação ou efeito de qualquer comunicação dirigida a terceiro. § 1º Pratica, também, crime de violação
de telecomunicações quem ilegalmente receber, divulgar ou utilizar, telecomunicação interceptada. § 2º Sòmente os serviços fiscais das estações
e postos oficiais poderão interceptar telecomunicação. I – A recepção de telecomunicação dirigida
por quem diretamente ou como cooperação esteja legalmente autorizado; II – O conhecimento dado: a) ao destinatário da telecomunicação ou
a seu representante legal; b) aos intervenientes necessários ao curso
da telecomunicação; c) ao comandante ou chefe, sob cujas ordens
imediatas estiver servindo; d) aos fiscais do Govêrno junto aos concessionários
ou permissionários; e) ao juiz competente, mediante requisição
ou intimação dêste. Single paragraph. Não estão compreendidas
nas proibições contidas nesta lei as radiocomunicações destinadas a ser livremente recebidas, as
de amadores, as relativas a navios e aeronaves em perigo, ou as transmitidas nos casos de
calamidade pública. Art 57. Não constitui violação de telecomunicação: I – A recepção de telecomunicação dirigida
por quem diretamente ou como cooperação esteja legalmente autorizado; II – O conhecimento dado: a) ao destinatário da telecomunicação ou
a seu representante legal; b) aos intervenientes necessários ao curso
da telecomunicação; c) ao comandante ou chefe, sob cujas ordens
imediatas estiver servindo; d) aos fiscais do Govêrno junto aos concessionários
ou permissionários; e) ao juiz competente, mediante requisição

calamidade pública. Art. 58. Nos crimes de violação da telecomunicação,
a que se referem esta Lei e o artigo 151 do Código Penal, caberão, ainda as seguintes
penas: (Substituído pelo Decreto-lei nº 236, de 28.2.1967) I – Para as concessionárias ou permissionárias
as previstas no artigos 62 e 63, se culpados por ação ou omissão e independentemente
da ação criminal. II – Para as pessoas físicas: a) 1 (um) a 2 (dois) anos de detenção ou
perda de cargo ou emprego, apurada a responsabilidade em processo regular, iniciado com o afastamento
imediato do acusado até decisão final; b) para autoridade responsável por violação
da telecomunicação, as penas previstas na legislação em vigor serão aplicadas em
dobro; c) serão suspensos ou cassados, na proporção
da gravidade da infração, os certificados dos operadores profissionais e dos amadores
responsáveis pelo crime de violação da telecomunicação. Art. 59. As penas por infração desta lei

nº 236, de 28.2.1967) § 1º Nas infrações em que, o juízo do
CONTEL, não se justificar a aplicação de pena, o infrator será advertido, considerando-se
a advertência como agravante na aplicação de penas por inobservância do mesmo ou de
outro preceito desta Lei. (Incluído pelo Decreto-lei nº 236, de 28.2.1967) § 2º A pena de multa poderá ser aplicada
isolada ou conjuntamente, com outras sanções especiais estatuídas nesta Lei. (Incluído

de 3 em 3 anos, de acordo com os níveis de correção monetária. (Included by Decree Law

compete: (Substituído pelo Decreto-lei nº 236, de 28.2.1967) a) ao CONTEL: multa e suspensão, em qualquer

a infração cometida, considerados os seguintes fatores: (Substituído pelo Decreto-lei nº
236, de 28.2.1967) a) gravidade da falta; b) antecedentes da entidade faltosa; c) reincidência específica. Art. 62. A pena de multa poderá ser aplicada
por infração de qualquer dispositivo legal ou quando a concessionária ou permissionária
não houver cumprido, dentro do prazo estipulado, exigência que tenha sido feita pelo CONTEL.
